Terms of Service
These terms are the agreement between you and Bonghyun Jung (TeamHealers) (“we”, “us”) about your use of Smithmare (the “Game”). By signing in you accept them. If you do not, do not use the Game.
1. Who may play
You must be at least 13 years old, or older if your country sets a higher age for consenting to online services — 14 in Korea, 16 in parts of the EEA. If you are a minor under the law where you live, you need your parent or guardian’s permission, and they accept these terms with you.
2. Your account
You sign in with Google or Apple. Your account is personal to you. Do not share it, sell it, buy one, or transfer it. You are responsible for what happens under your account, and for keeping your sign-in provider secure.
One person, one account. Creating additional accounts to farm rewards, dodge limits, or evade a suspension is a breach of these terms.
3. Your licence to play
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game for your own entertainment. We keep all rights in the Game — its code, art, text, audio, systems, and name.
You may not:
- reverse-engineer, decompile, or modify the Game, except where the law says you may;
- use bots, macros, emulator automation, memory editors, packet tools, or modified clients;
- exploit a bug for gain instead of reporting it;
- attack, overload, or probe our servers;
- sell, trade, or advertise accounts, items, or in-game currency for real money outside the Game.
4. Virtual items and currency
The Game contains virtual currency (gems, gold, and other resources) and virtual items (equipment, tickets, materials). Read this section carefully, because it is where most misunderstandings happen.
- Virtual items and currency are a licence to use a feature of the Game, not property. You do not own them.
- They have no monetary value outside the Game and cannot be exchanged for money, goods, or anything of value from us or anyone else.
- They are not transferable between accounts.
- We may change, rebalance, or remove any item, currency, or system as part of operating and balancing the Game. We will announce material changes in advance where we reasonably can.
- Unspent currency and unused items are forfeited when your account is deleted or terminated, and when the Game shuts down (see §9).
5. Purchases and refunds
Purchases are processed by Google Play or the App Store, not by us. Their terms and their payment methods apply.
Purchased content is delivered to your account immediately. Because it is digital content delivered at once, your statutory right of withdrawal ends on delivery under Korean e-commerce law — but this does not apply to content you have not yet used, and it does not limit any refund right you have under the law where you live.
Refund requests go to the store that took the payment. We will consider a direct refund where a purchase failed, was duplicated, or was not delivered because of a fault on our side. Write to support@smithmare.com.
If a purchase is charged back or refunded, we may remove the content it bought, and any in-game gains derived from it.
6. Random items and published odds
The Game contains items obtained at random, including paid random items. We publish the exact probability of every outcome in-game, on a screen you can open at any time without spending anything, as required by Korean law on probabilistic items.
If published odds and actual behaviour ever disagree, the published odds are the commitment and we will correct the discrepancy and compensate affected players.
7. Fair play and enforcement
Combat and progression are resolved on our servers. Attempts to manipulate the client will not change your result, but they will be visible to us.
If you breach these terms we may, in proportion to what happened: reverse illegitimate gains, remove items or currency, suspend your account temporarily, or terminate it. For anything short of severe or repeated abuse we will tell you what happened and give you a way to respond. Where we terminate an account for cause, unspent paid currency is not refunded.
8. Availability
We aim to keep the Game running, but we do not promise it will always be available. We may take it down for maintenance, updates, or emergencies. Idle progression is calculated from elapsed time and is not lost by short outages.
9. Ending the service
You may stop playing and delete your account at any time from Settings → Delete account.
If we decide to shut the Game down, we will give at least 30 days’ notice in the app and on this site, and we will stop selling paid currency immediately upon that notice. Where the law where you live requires a refund of unspent paid currency on shutdown, we will honour it.
10. Disclaimers
The Game is provided “as is”. To the extent the law allows, we do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose. Nothing here excludes a warranty or right that cannot legally be excluded — and if you are a consumer, you keep every mandatory right the law of your country gives you.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, or consequential loss, or for lost virtual items, currency, or progress that is not caused by our fault.
Where we are liable, our total liability to you is limited to the greater of (a) what you paid us in the 12 months before the event, or (b) USD 100.
Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
12. Changes to these terms
We may update these terms. We will post the new version here and, if the change materially affects your rights, show it in the app at least 7 days before it takes effect. Continuing to play after that date means you accept it. If you do not, delete your account.
13. Governing law and disputes
These terms are governed by the law of the Republic of Korea. Disputes go to the Seoul Central District Court.
If you are a consumer, this does not deprive you of the protection of the mandatory law of your country of residence, or of the right to bring proceedings in your local courts.
Please write to us first — most things are resolved faster that way than by anyone’s lawyer.
